I have an automotive repair business. A customer paid me ,366 in Feb. 2004 but the check was no good.
I have received a judgement from the CA court in my favor (Dec. 2005 ) and the award is just over ,000 (damages, interest, costs) with interest to accrue per day. The customer has now moved out of state.
I spoke to a collections lawyer who wants ,000 (10% of ,000), plus 0 court fees. Then they would take 33% of
what is recovered.
I called the customer to give them one more chance to make good on it, and they hung up on me. Should I pursue it? Or am I throwing good money after bad?

I agree with the first poster about trying to negotiate the fees. You might also get price quotes from others.

The suit would have to be domesticated to the state the person moved to. If wage garnishment is allowed in that state, you would have to petition the court for garnishment.

Before you sign on the dotted line, you should do some investigating on your own.

Find out the wage garnishment and exemption laws in the state the person moved to. If the state does not allow garnishment and has tough exemption laws, then you “might” be throwing good money after bad. There could be a good chance that all you would be able to do is place a lien on property and sit on it hoping they eventually sell.

Learn the collecting laws in the state the person moved to.
Who ever you hire “must” follow the laws of that state, must be licensed and/or bonded in the state to collect if the state requires it, etc.
Some states will allow holding not only the collector/collection lawyer responsible but also the original creditor responsible for the violations the collector/collection lawyer commit – if the debtor files on the violations.

The following is only my opinion
If the new state does not allow garnishment and has strong exemption statutes, if it were me I wouldn’t go to the expense to pursue such an iffy debt.
If that is the case I would probably find a collector who would purchase the debt and take the loss as a tax write off.

If the new state does allow wage garnishment, minimal exemption statutes etc, if it were me I would strongly think about pursuing it – if I found a collection lawyer that has a good track record for abiding the law in the state where the debtor lives
